Brazilian Supreme Court Justice Alexandre de Moraes has taken the first steps toward banning the X social media platform in Brazil.
De Moraes recently launched an inquiry into X and its owner Elon Musk for “obstruction of justice” and “incitement to crime,” this following a conflict between de Moraes and Musk.
Writing for Noticias UOL, Andreza Matais says that representatives for de Moraes’ office reached out to the National Telecommunications Agency (Anatel) of Brazil to find out how X can be removed from the country.
Anatel president Carlos Baigorri reportedly contacted the main telephone operators in Brazil to notify them that they should remain on standby in the event that a court order is issued requiring X to be removed.
The Brazilian government has already blocked a host of popular X accounts and censored various posts. Musk is demanding to know why the Minister of the Supreme Federal Court of Brazil wants to censor these accounts.
“This aggressive censorship appears to violate the law will [sic] of the people of Brazil,” Musk wrote.

Musk has promised to release documents showing what Moraes is demanding of X, which Musk claims violates Brazilian law.
“This judge has brazenly and repeatedly betrayed the constitution and people of Brazil,” Musk tweeted. “He should resign or be impeached.”
As it stands, X is prohibited from reactivating any accounts that Moraes has said need to be removed. If X violates this order, each offense is subject to a $20,000 fine.
“X Corp. has been forced by court decisions to block certain popular accounts in Brazil,” Musk’s company said in a statement. “We have informed those accounts that we have taken this action.”
“We do not know the reasons these blocking orders have been issued. We do not know which posts are alleged to violate the law. We are prohibited from saying which court or judge issued the order, or on what grounds.”
X says it is also prohibited from publicly revealing which accounts are impacted by the order, adding that Brazil is threatening “daily fines if we fail to comply.”
“We believe that such orders are not in accordance with the Marco Civil da Internet or the Brazilian Federal Constitution, and we challenge the orders legally where possible,” the company added.
“The people of Brazil, regardless of their political beliefs, are entitled to freedom of speech, due process, and transparency from their own authorities.”
Keep in mind that none of this is possible with Brighteon.io, which unlike X is decentralized and cannot be blocked.
Michael Shellenberger commented on the matter as well by accusing Brazil of engaging in “a sweeping crackdown on free speech.”
“De Moraes has thrown people in jail without trial for things they posted on social media,” Shellenberger said. “He has demanded the removal of users from social media platforms.”
“And he has required the censorship of specific posts, without giving users any right of appeal or even the right to see the evidence presented against them.”
According to Shellenberger, de Moraes and the Superior Electoral Court demanded back when X was still Twitter that the social media platform “reveal personal details about Twitter users who used hashtags he did not like” as well as provide the Brazilian government “access to Twitter’s internal data, in violation of Twitter policy.”
At issue back then was de Moraes wanting to stop supporters of then-President Jair Bolsonaro from having a voice online.
